Other Conditions and Policies Governing Property Offers
By transmitting property offer, the Offeror agrees to be bound by these Other Conditions and Policies stipulated below.
1. Only property offers with all the minimum requirements above shall be evaluated. Entry of the property offer through the online portal, or ALI CLAU’s receipt of complete documentary requirements shall be considered as the official lot offer date.
2. The receipt of a partial/complete property offer nor a request for additional documents, information, or site visit shall not constitute or be deemed to constitute acceptance of the said offer; constitute or give rise to any obligation, legal or otherwise, on the part of ALI to the Offeror and his principals; bind ALI to only negotiate, deal and/or correspond with the Offeror for the property; and be construed to mean that no prior Offeror or offer for the same property has been received or considered by ALI.
In no case shall ALI be bound by any form of verbal communication purportedly between any person who acts in representation of ALI.
3. Once an offer has been declined, ALI shall be under no obligation to contact the Offeror should the same property be reconsidered.
4. In the event of multiple offers for the same property, ALI may deal with any broker in accordance with the attendant circumstances and its internal rules, guidelines, policies and requirements, including dealing with the Offeror presenting an original, exclusive ATS. In the exercise of its discretion, ALI shall take into consideration the preference granted to the Offeror who first submitted all minimum documentary requirements.
5. The Offeror represents, warrants, and covenants that he is in strict compliance with Republic Act No. 9646 (Real Estate Service Act of the Philippines), its rules and regulations, including Section 28 of thereof when applicable. While payment of the broker’s commission (if any) is the responsibility of the seller, and ALI is not privy to the relationship between the owner-seller and broker/attorney-in-fact, ALI and its representatives shall not consent to or knowingly tolerate violation of the Real Estate Service Act of the Philippines.
6. By transmitting a property offer, the Offeror represents and warrants that (a) all information contained in the property offer are complete, accurate, true, and correct, and does not contain any untrue or misleading statement, or omits to state a material fact; (b) all documents are valid, subsisting, and faithful reproductions of the authentic and genuine copies; and (c) he is authorized to disclosure of personal, sensitive and/or privileged information of persons mentioned or referred to the documents, including the owner(s) of the property, and to accept all the conditions and policies of offering the property to ALI.
7. The Offeror, for himself and on behalf of his principals, give consent to ALI to collect, record, store, update, use, erase or otherwise process information, whether personal, sensitive or privileged, pertaining to himself/themselves, and the subject property offer for the purpose of lot evaluation. In this connection, the Offeror, for himself and on behalf of his principals, acknowledge that he has/they have read and understood the foregoing conditions and policies governing the property offer and data privacy practices of ALI accessible at: https://www.ayalaland.com.ph/privacy-policy/
8. ALI reserves the right to amend, modify, or in any way change the documentary requirements, modes, conditions and policies governing property offer, and ALI’s internal rules and guidelines without prior notice.
